Return to duty is the federally specified route back to safety-sensitive work for an employee who has failed or refused a regulated drug or alcohol test. It is not a company policy decision and an employer cannot shorten it. The sequence is set out in the federal rules, it runs through a qualified professional the employer does not choose, and it does not end when the employee returns to work.

The Substance Abuse Professional comes first

After a violation the employee must be evaluated by a Substance Abuse Professional, a qualified individual meeting credentials set out in the federal rules. The SAP evaluates the employee, prescribes education, treatment or both, and re-evaluates to confirm compliance before the employee may take a return to duty test. The employer must provide the employee with a list of qualified SAPs and may not select the treatment or decide that the process is complete. That separation is deliberate: the person deciding fitness to return is not the person who wants the driver back on the road.

The return to duty test itself

Once the SAP reports that the employee has complied, a return to duty test is conducted under direct observation, which is one of the few circumstances where observed collection is required. The result must be negative before the employee may perform any safety-sensitive function. For CDL holders the violation, the SAP process and the negative return to duty test are all recorded in the FMCSA Clearinghouse, so a driver's status there tells a prospective employer where in the process they are.

Follow-up testing is the long tail

The SAP also prescribes a follow-up testing plan: a minimum number of unannounced tests over a defined period, at least six in the first twelve months, and the SAP may extend follow-up testing for up to five years. Those tests are in addition to any random testing the employee remains subject to, they are directed by the SAP's plan rather than by the employer's discretion, and the employer must carry them out. This is the part most often missed when an employee moves between carriers mid-plan.

Where a consortium and a C/TPA fit

A consortium or third-party administrator manages testing programmes on behalf of employers, which for small carriers and owner-operators is the practical way to be in a random testing pool at all: a pool of one is not a random pool. A C/TPA can administer random selection, arrange collections, manage Clearinghouse queries and hold records, and it is also where much of the required supervisor drug and alcohol training is bought. What it cannot do is take on the employer's duties, which remain the employer's however much of the administration is contracted out.
